One of the pressing legal matters that individuals overlook is Estate Planning. “Despite a 3% increase in Estate Planning since 2022, 2 out of 3 American adults still don’t have a Will.” (Caring.com) In an effort to move towards reshaping how individuals view estate planning and forging a pathway to smart financial planning, Austin Legal Access started an innovative initiative to preserve and aid in multi-generational wealth for families. ALA will implement a pilot program, called Building Generational Wealth, that will provide free Simple Wills to individuals in the Austin, Texas area and surrounding areas.
In Texas, when a person passes away without a Will, the Texas Estates Code (law) describes how the person's property will be distributed amongst their heirs, if any. This also means that the wishes of the person that passed away may not align with Texas laws. “Having an estate plan is a continuation of financial planning and essential to ensur[ing] that [a person’s] efforts to provide for [their] loved ones pass into the future and [the Will will] act as a foundation to build[ing] multi-generational wealth and leav[ing] a legacy.” (Caring.com)

A Simple Will is a Will that distributes the assets of the testator according to the testator's wishes, but excludes testamentary trust and guardianship designations. A testator is the person who has made a Will. A testamentary trust is a type of trust created as part of a last will and testament.
